Terms and Conditions

1. General

1.1 These Terms and Conditions apply to all contracts, deliveries and services provided by Talheim Records e.U.

1.2 Any conflicting terms of the customer are hereby expressly rejected.

1.3 Amendments to these Terms and Conditions apply to all orders placed after the amendment has taken effect.

1.4 Orders may only be placed by persons who have reached the age of 18. Persons under 18 require the consent of their legal guardian.

2. Conclusion of Contract

2.1 The customer's order constitutes an offer to conclude a purchase contract.

2.2 After placing an order, an automatic confirmation email is sent. This confirmation does not yet constitute acceptance of the offer.

2.3 The contract is concluded only when we accept the order by sending a separate order confirmation email or by dispatching the goods.

2.4 In case of advance payment, the invoice amount must be received within seven days after the contract has been concluded.

2.5 If payment is not received within this period, we reserve the right to withdraw from the contract and sell the goods elsewhere.

3. Prices

All prices are stated in Euro and include the applicable value-added tax (VAT). Shipping costs are displayed during the checkout process.

4. Delivery

Shipping is carried out via our logistics partner Österreichische Post AG.

5. Payment Methods

Available payment methods are displayed during the checkout process. Payments are processed through our payment service providers.

6. Delivery Delays

Delivery delays caused by force majeure or events beyond our control (such as strikes, official orders, natural disasters, operational disruptions, fire or water damage) release us from delivery obligations for the duration of the disruption.

7. Transfer of Risk

For consumers, the risk of accidental loss or deterioration of the goods passes to the consumer or a person designated by the consumer upon delivery of the goods.

8. Damages and Reminder Fees

8.1 If damage occurs due to the customer's conduct, we reserve the right to claim compensation.

8.2 Additional costs may arise if the customer refuses delivery or if a shipment is returned due to unsuccessful delivery attempts. Such costs may be charged to the customer.

8.3 In case of overdue payments, a processing fee of EUR 40 may be charged. Further claims remain reserved.

9. Warranty

Warranty claims are governed by the statutory provisions of Austrian law.

10. Liability

We are not liable for property damage caused by slight negligence, unless mandatory legal provisions require otherwise.

11. Retention of Title

The goods remain the property of Talheim Records e.U. until full payment has been received.

12. Right of Withdrawal

Consumers are entitled to a statutory right of withdrawal.

13. Contract Language

The contract language is German.

14. Storage of Contract Text

The contract text will be stored by us. Order details and these Terms and Conditions will be sent to you by email.

15. Data Protection

Information about the processing of personal data can be found in our Privacy Policy.

16. Misuse

Fraudulent orders or the intentional provision of false information with the intention of causing damage may be reported to the authorities.

17. Governing Law and Jurisdiction

All contracts are governed by Austrian law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

Where legally permissible, the place of jurisdiction is the competent court at the registered office of Talheim Records e.U. in Vienna.

18. Severability Clause

If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
